TERMS OF SERVICE.

You must be at least 13 years old to use the Service. If you're between 13 and 18, you confirm a parent or legal guardian has read these Terms and agrees to them on your behalf. You must provide accurate information when you sign up.

You're responsible for activity on your account, including keeping your Google sign-in secure. Tell us immediately if you suspect unauthorized access. We can suspend or terminate accounts that violate these Terms.

You agree NOT to use Xam Recruiting to:

• Send spam, threatening, harassing, deceptive, or false content to coaches
• Impersonate another person or misrepresent your athletic stats, grades, identity, or eligibility
• Scrape, redistribute, or resell our coach database to third parties
• Attempt to break, reverse-engineer, or interfere with the Service
• Send mass commercial advertisements unrelated to college recruiting
• Violate applicable laws including CAN-SPAM and FERPA

You're responsible for the content of every email sent through your account.

Xam Recruiting is offered with a 14-day free trial. After the trial, paid plans renew automatically at the price displayed at checkout ($199/month or $1,499/year as of the date of this policy). You can cancel anytime from your account settings or through the Stripe billing portal.

Cancellation: When you cancel, your subscription remains active until the end of the current billing period, then your account switches to read-only.

Refunds: We don't offer prorated refunds for partial months or years. If you believe you've been charged in error, email xcuesta@xamx.org within 14 days and we'll review case-by-case.

First Reply Guarantee: If, within your first 30 days of paid subscription, you (a) completed your profile, (b) connected Gmail, (c) sent at least one full 3-email sequence to at least 25 coaches, and (d) received no reply from any college coach, we'll credit your next month. Email us with proof to claim.

Price changes: We may change prices with 30 days notice. Existing subscribers keep their current rate through their next renewal date.

Our coach database is compiled from publicly available sources (school athletic websites, NCAA directories, and similar). We update it regularly, but we cannot guarantee every contact is current or accurate. We provide the database "as is" for personal recruiting use only. Redistribution or resale is prohibited.

When you send an email through Xam, it is sent through YOUR connected Gmail account, not through Xam's servers. This means the email is fully attributed to you and counts against your Gmail's sending limits. Xam is a tool that drafts and delivers emails on your behalf — you are the sender, you are responsible for the content, and you agree to send only legitimate recruiting communications.

Xam Recruiting is a tool that helps you reach college coaches. The Service does not guarantee:

• Coaches will reply
• You'll receive scholarship offers
• You'll make a college roster
• Any specific outcome related to your athletic career

Recruiting outcomes depend on many factors outside our control, including your athletic ability, academics, fit with each program, NCAA eligibility, timing, and luck. The First Reply Guarantee in Section 4 is the only outcome guarantee we make, and it applies only as written.

The Service, including all software, designs, copy, and content we create, belongs to Xam Recruiting. You can use it for personal recruiting purposes while you have an active account. You retain ownership of the content YOU create (your profile, your emails, your templates), but you grant us a license to host, display, and process that content as needed to provide the Service.

We work to keep Xam Recruiting available, but we don't promise 100% uptime. Scheduled maintenance, infrastructure outages, or third-party service interruptions (Google, Stripe, etc.) may affect availability. We're not liable for losses caused by downtime.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent allowed by law.

To the maximum extent allowed by law, Xam Recruiting will not be liable for indirect, incidental, consequential, or punitive damages — including lost recruiting opportunities, lost scholarship offers, or lost college admissions — arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

You can delete your account anytime from Settings → Danger Zone. We can suspend or terminate accounts that violate these Terms, with or without notice. After termination, the obligations in Sections 7–11 survive.

We may update these Terms occasionally. If we make material changes, we'll notify users by email or in-app notification. Continued use after changes take effect means you accept the new Terms.

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Virginia.
